Please read these terms carefully before making a booking. The capacity in which TGB acts, and the protection applying to your booking, may vary depending upon the particular golf break you purchase. This will be made clear in your booking information.
- Our role
Tuition Golf Breaks arranges and hosts tuition golf breaks in the UK and overseas.
Depending on the particular trip, TGB may act either:
- a) As the organiser/principal
For certain golf breaks, including trips where TGB itself combines and sells the accommodation, golf and/or other travel services as one inclusive package, TGB will act as the organiser of your package.
Where the Package Travel and Linked Travel Arrangements Regulations 2018 apply to your booking, you will benefit from the rights provided by those Regulations.
- b) As an agent
For certain trips, TGB may act as an agent for a separate tour operator which is responsible for arranging the travel package.
Where TGB acts as an agent, the identity of the tour operator will be made clear to you and your package will be subject to the relevant tour operator’s booking terms and financial protection arrangements in addition to any TGB-specific arrangements relating to coaching and hosting.
For example, some TGB Turkey golf breaks are arranged through a specialist golf tour operator, with TGB acting as agent and providing the PGA coaching and hosting element of the trip.
- What your golf break includes
The services included in your booking will be clearly set out in the relevant trip information and/or booking confirmation.
Depending on the trip these may include:
- accommodation;
- golf and pre-booked tee times;
- PGA Professional coaching;
- hosted golf;
- meals and/or drinks;
- airport or resort transfers;
- range balls;
- competitions and organised activities; and
- other services specifically advertised as being included.
Unless specifically stated otherwise, anything not listed as included should be regarded as excluded from the package.
Flights are only included where this is expressly stated in the trip information or booking confirmation.
- Accuracy of information
TGB makes reasonable efforts to ensure that information contained on its website, emails, quotations, social media, promotional material and other communications is accurate.
Occasionally errors, omissions or changes may occur.
We reserve the right to correct an obvious error or amend information before your booking is confirmed.
Once your booking has been confirmed, any changes will be dealt with in accordance with these booking conditions and, where applicable, the Package Travel and Linked Travel Arrangements Regulations 2018.
- Making a booking
A booking is not confirmed until the required deposit has been received and TGB has issued confirmation of the booking.
Your confirmation will normally be sent by email.
Please check your confirmation carefully and notify TGB promptly if any information is incorrect.
For group bookings, the person making the booking will normally be treated as the lead name. The lead name confirms that they have authority to make the booking and communicate on behalf of the other members of their booking.
Each traveller remains responsible for complying with these booking conditions.
- Deposits and balance payments
Unless different payment terms are specifically stated for a particular trip, a deposit of £100 per person is required to secure a booking.
Deposits are normally non-refundable, subject to your statutory rights and any rights you may have under the Package Travel and Linked Travel Arrangements Regulations 2018.
The remaining balance will normally be due 10 weeks before departure, unless a different payment schedule is stated in your booking confirmation.
If you book within 10 weeks of departure, the full balance may be payable at the time of booking.
If payment is not received by the stated deadline, TGB may contact you requesting payment and may ultimately treat the booking as cancelled by you. Applicable cancellation charges may then apply.
- Prices
The total price payable for your golf break will be stated before your booking is confirmed.
TGB generally sells its own organised golf breaks for one inclusive package price, rather than separately charging the customer the individual prices paid to each supplier.
Single occupancy supplements and other optional supplements may apply and will be explained before booking.
Any optional extras purchased directly from a hotel, golf course, airline or other supplier are the responsibility of the traveller unless TGB has expressly agreed to include them within the package.
- Payment methods
TGB may accept payment by methods including bank transfer and credit/debit card.
Available payment methods will be communicated when payment is requested.
TGB operates primarily as a cashless business.
- Financial protection
The financial protection applying to your booking will depend upon the type of trip purchased and the capacity in which TGB is acting.
For qualifying package holidays where TGB acts as the organiser, TGB will maintain the financial protection required by the Package Travel and Linked Travel Arrangements Regulations 2018.
The specific financial protection applying to your booking will be explained in the information supplied to you for that trip.
Where TGB acts as an agent for another tour operator, the financial protection applicable to the package will be that provided by the relevant tour operator, as specified in the booking information and/or that operator’s terms and conditions.
TGB does not make a blanket representation that every golf break it sells is ATOL or ABTA protected. The protection applying to a particular trip will depend upon how that trip is arranged.
- Travel insurance
All customers are strongly advised to obtain comprehensive travel insurance appropriate to their trip as soon as they make their booking.
Your policy should provide suitable cover for your personal circumstances and may need to include cancellation, medical expenses, personal possessions, golf equipment and other appropriate risks.
For overseas travel, customers should ensure that their insurance provides suitable overseas medical and repatriation cover.
TGB does not provide insurance advice and does not check customers’ individual insurance policies.
It is your responsibility to ensure that the cover you purchase is suitable for your needs.
- Cancellation by you
If you wish to cancel your booking, you must notify TGB in writing as soon as possible.
Unless different cancellation terms have been expressly provided for your particular trip, the following cancellation charges will normally apply:
More than 60 days before departure: loss of deposit
59–29 days before departure: 50% of the total booking price
28 days or fewer before departure: 100% of the total booking price
The cancellation charge reflects costs and commitments that TGB may already have incurred with hotels, golf courses and other suppliers.
Where TGB is able to recover money from suppliers following your cancellation, we will take this into account where appropriate.
Different supplier cancellation conditions may apply to particular trips. Where this materially affects your booking, you will be informed.
Nothing in this section limits any statutory cancellation or refund rights that apply to a qualifying package under the Package Travel and Linked Travel Arrangements Regulations 2018.
Customers are strongly advised to obtain appropriate travel insurance to protect themselves against circumstances which may require them to cancel.
- Transferring your booking
Where your booking is a package covered by the Package Travel and Linked Travel Arrangements Regulations 2018, you may have the right to transfer the booking to another traveller who satisfies the conditions applicable to the trip.
You should contact TGB as soon as possible if you wish to transfer your place.
Any reasonable costs actually incurred in making the transfer may be payable by you.
Changes may also be subject to restrictions imposed by airlines, hotels, golf courses or other suppliers.
- Changes made by TGB
Occasionally TGB or one of its suppliers may need to make a change to the arrangements advertised or confirmed.
Minor changes may be made where reasonably necessary.
If TGB is acting as organiser and is required to make a significant change to an essential element of a qualifying package before departure, customers will be informed as soon as reasonably possible and provided with the options and rights required by applicable package travel legislation.
Where appropriate these may include accepting the proposed change, accepting a suitable alternative arrangement or terminating the package and receiving the refund to which you are legally entitled.
- Cancellation by TGB
TGB may occasionally need to cancel a golf break, including where a clearly advertised minimum number of participants required for a particular trip has not been reached.
Where TGB acts as organiser, any cancellation will be handled in accordance with applicable package travel legislation.
If TGB cancels a qualifying package, customers will receive the refund required by law.
TGB will not cancel a package merely to avoid providing a service that it is contractually obliged to provide.
- PGA Professional coaching and hosting
TGB golf breaks normally include coaching and/or hosting from a PGA Professional where this is stated as part of the package.
If an assigned PGA Professional becomes ill, is injured or is otherwise genuinely unable to attend, TGB will make reasonable efforts to provide another suitably qualified PGA Professional.
Where no suitable replacement can reasonably be provided, TGB will consider appropriate alternative arrangements and/or a price reduction or refund relating to the affected element of the package, taking account of the circumstances and any applicable statutory rights.
- Golf courses, weather and playing conditions
Golf is an outdoor activity and course conditions can be affected by weather, maintenance and other circumstances outside TGB’s control.
This may result in:
- course closures;
- temporary greens;
- trolley or buggy restrictions;
- delays;
- changes to tee times;
- maintenance work; or
- other restrictions.
Where a booked golf service cannot be provided, TGB will work with the golf course or relevant supplier to seek a reasonable alternative, refund or credit where appropriate.
Where TGB acts as organiser of a qualifying package, this section does not remove TGB’s statutory responsibility for the proper performance of the package.
- Golf etiquette, ability and dress codes
Customers must comply with reasonable rules, dress codes, safety requirements and standards of behaviour imposed by golf courses, hotels and other venues.
Some golf courses may require evidence of an appropriate handicap or golfing ability.
Where TGB is aware of a specific requirement, we will endeavour to make customers aware of it before travel.
TGB cannot accept responsibility where a customer is refused access or removed from a venue because they have failed to comply with a reasonable and properly communicated rule or because of their own inappropriate behaviour.
- Behaviour
Customers are expected to behave reasonably and respectfully towards other guests, TGB representatives, PGA Professionals, venue staff and suppliers.
TGB may take reasonable action where a customer’s behaviour creates a safety risk, causes significant disruption or distress to others, or risks damage to property.
Serious misconduct may result in the customer being required to leave an activity or accommodation and the customer may be responsible for resulting costs where legally appropriate.
- Passports, visas and travel requirements
Customers are responsible for ensuring that they possess the correct passport, visa and other documentation required for their journey.
Customers should check current official travel requirements for their destination before departure.
Requirements can vary according to nationality and personal circumstances.
TGB cannot accept responsibility where a traveller is unable to travel because they have failed to obtain documentation which they were responsible for obtaining.
- Health and fitness
Customers are responsible for considering whether they are sufficiently fit and able to participate in the golf and other activities included in their trip.
Please inform TGB before travel of any relevant accessibility requirements or other requirements that may affect the arrangements we need to make for your trip.
We will make reasonable efforts to assist and to establish whether the proposed trip is suitable.
- Suppliers
TGB uses third-party suppliers including hotels, golf resorts, golf courses, transfer providers and tour operators to provide elements of its golf breaks.
Where TGB acts as organiser of a qualifying package, the fact that a service is actually performed by a third-party supplier does not remove the responsibilities TGB has under applicable package travel legislation.
Customers must nevertheless comply with reasonable conditions and safety requirements imposed by individual suppliers.
- Problems during your trip
If you experience a problem with any part of your golf break, please notify TGB or the relevant supplier as soon as reasonably possible while you are away.
Giving us an opportunity to address the issue during the trip will often allow the matter to be resolved quickly.
Where TGB acts as organiser, we will provide reasonable assistance and seek to remedy any lack of conformity with the contracted package in accordance with applicable law.
- Complaints
If a problem has not been resolved during your trip, please contact TGB after your return with details of your complaint.
Complaints should be sent to:
Ross Whitelock
Tuition Golf Breaks
ross@tuitiongolfbreaks.co.uk
Please provide sufficient information for us to investigate the matter, including the trip concerned, what happened and any relevant supporting information.
TGB will investigate complaints and liaise with the relevant supplier where appropriate.
- Liability
TGB’s liability depends upon the capacity in which it acts for the particular booking.
Where TGB acts as organiser of a package covered by the Package Travel and Linked Travel Arrangements Regulations 2018, TGB accepts the responsibilities imposed upon an organiser by those Regulations.
Where TGB acts solely as an agent for a disclosed tour operator, responsibility for performance of the package will normally rest with that tour operator subject to applicable law and the relevant booking conditions.
Nothing in these terms is intended to exclude or restrict liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence.
- Events outside our control
TGB and its suppliers may occasionally be affected by serious circumstances outside their reasonable control.
These could include extreme weather, natural disasters, significant transport disruption, government action, serious security incidents or other extraordinary circumstances.
Your rights in these circumstances will depend upon the nature of the booking and applicable law.
Nothing in this clause removes rights you have under the Package Travel and Linked Travel Arrangements Regulations 2018 where those Regulations apply.
- Personal information
TGB will use personal information supplied in connection with your booking for the purpose of administering and delivering your golf break and for other purposes permitted by applicable data protection law.
Information may need to be provided to hotels, golf courses, tour operators, transfer companies and other suppliers where necessary to fulfil your booking.
Further information about how personal data is handled should be provided in TGB’s Privacy Policy.
- Governing law
These booking conditions and any dispute or claim arising from them are governed by the laws applicable in England and Wales, subject to any mandatory consumer rights which provide otherwise.
- Your statutory rights
Nothing in these booking conditions is intended to remove or reduce any rights which customers have under applicable UK consumer law or the Package Travel and Linked Travel Arrangements Regulations 2018.
If there is any conflict between these booking conditions and a mandatory legal right, the mandatory legal right will apply.
